This policy explains what we collect through mossandmoss.com, why we collect it, and what we do with it. It covers this website. It does not cover how we handle client files, which is governed by our engagement letter and by our professional duties of confidentiality.

What we collect

Information you give us. If you fill in our contact form or email us, we receive what you send: your name, email address, phone number if you provide it, and whatever you write in the message. If you become a client and pay an invoice online, our payment processor collects your payment details — we do not see or store your full card or bank account number.

Information collected automatically. Our website host records standard technical data when you visit: your IP address, browser type, device type, the pages you looked at, the date and time, and the site you came from. This happens on most websites and is used to keep the site running and to see roughly how it is being used.

Cookies. Our website host sets cookies that are needed for the site to work and for basic visitor measurement. You can block or delete cookies in your browser settings. Parts of the site may not work properly if you do.

How we use it

We use this information to:

  • reply to your message and answer your question;
  • run a conflicts check if you ask us to take on a matter;
  • provide legal services if you become a client;
  • take payment for our invoices;
  • keep the site working, secure, and reasonably useful; and
  • meet our legal, regulatory, and professional obligations.

We do not use your information to send marketing emails unless you have asked us to.

We do not sell your information

We do not sell your personal information. We do not rent it, and we do not trade it for anything of value.

We share it only in these situations:

  • Service providers. Our website host, Squarespace, stores this site and the messages sent through it. Our payment processor, LawPay, handles online payments. Each has access only to what it needs to provide its service.
  • When you ask us to. For example, sending a document to another party on your instructions.
  • When the law requires it. A court order, a subpoena, or a regulator’s demand. Where we are permitted to tell you first, we will.

A note about the contact form

Please don’t send confidential or sensitive information through the contact form. Sending it does not create an attorney-client relationship, and information you send before we sign an engagement letter may not be privileged. See our Disclaimer.

How long we keep it

We keep inquiries that don’t become matters for a limited period, so that we can run conflicts checks properly, then delete them.

Client files are kept for longer. How long depends on the type of matter and the record-keeping rules that apply to it. Our engagement letter sets out our file retention practice for your matter.

Basic server and analytics data is kept by our host for the period set in its own retention settings.

Security

We take reasonable steps to protect information in our care. Our site uses encryption in transit (HTTPS). Access to our systems is limited to people at the firm who need it. Our host and payment processor maintain their own security controls.

No website or email system is completely secure. We can’t promise that a transmission over the internet will never be intercepted. Please bear that in mind when deciding what to send us and how.

Your choices and your rights

You can ask us to:

  • tell you what personal information we hold about you;
  • correct information that is wrong; or
  • delete information we no longer need to keep.

Some of these rights depend on where you live and on the law that applies to you. Some are limited by our professional obligations — for example, we may have to keep a client file even if you ask us to delete it. Tell us what you want and we will explain what we can do.

Write to admin@mossandmoss.com with the subject line “Privacy request.” We will respond within a reasonable time and may need to verify who you are first.

Children

This site is meant for adults. It is not directed at children, and we do not knowingly collect personal information from anyone under 13. If you believe a child has sent us information, email admin@mossandmoss.com and we will delete it.

Changes to this policy

If we change this policy, we will post the new version here and update the “Last updated” date above. Significant changes will be noted on the page for a period after they take effect. Please check back from time to time.
